These Terms & Conditions apply to services provided by Sharmaine Entwistle trading as Shoots Photographs, including portrait and family photography, weddings and life events, event and documentary photography, commercial photography, video and visual storytelling, creative photography, boudoir and intimate photography, fetish/kink photography, and photography training or mentoring.
Some terms apply to all clients, while others apply specifically to private and consumer bookings, particular types of photography, or commercial and organisational commissions.
A Consumer Client means an individual booking services mainly for personal purposes.
A Commercial Client means a business, sole trader, charity, organisation, agency, public body or other organisation commissioning services for business, professional, promotional, marketing or organisational purposes.
A quotation, booking confirmation or individual service agreement may contain additional terms specific to a particular booking or commission. Where a booking-specific written term expressly differs from these general terms, the booking-specific term will apply to that booking, subject to applicable law.

Core Terms
These sections apply to all relevant bookings unless specifically stated otherwise.
1. Booking & Confirmation
1.1. A booking may be confirmed by signing or accepting a booking agreement, accepting a quotation in writing, confirming by email that you wish me to proceed, issuing a purchase order, paying a booking fee, deposit or invoice, or by another method expressly agreed between us.
1.2. Where a booking fee, deposit or other confirmation requirement applies, the date is not secured until that requirement has been completed.
1.3. Your quotation, booking agreement or booking confirmation will identify the main details of the service where applicable, including the date, time, location, duration or coverage, type of service, agreed concept or purpose, deliverables, number of final images where specified, intended usage, fees, payment arrangements and any particular requirements agreed in advance.
1.4. Clients are responsible for checking the booking information supplied and notifying me promptly if anything is incorrect or incomplete.
1.5. Where these Terms & Conditions are supplied or linked in a quotation, booking confirmation or other pre-booking correspondence, acceptance of the quotation, signing an agreement, issuing an instruction or purchase order, paying a booking fee or instructing Shoots Photographs to proceed constitutes acceptance of these terms.
1.6. A client’s own standard purchase terms, purchase-order wording or supplier terms do not vary these Terms & Conditions unless Shoots Photographs expressly agrees to the variation in writing.
2. Pricing & Payment
2.1. All prices are quoted in GBP (£). Any applicable taxes will be stated where relevant.
2.2. Prices described as “from” or “starting from” are indicative. The final price will depend upon the requirements of the booking, including duration, location, travel, complexity, equipment, deliverables, intended usage and additional services.
2.3. My fees are charged for the professional service provided and may include consultation, planning, preparation, reserved diary time, professional equipment, travel where included, attendance, photography or filming, professional skill and judgement, image selection, editing, post-production, file preparation, gallery preparation, administration and agreed image licensing.
2.4. Additional photographs, prints, albums, wall art, specialist retouching, compositing, additional photography, additional editing, additional attendance, equipment hire, additional travel and other extras are chargeable unless expressly included in the agreed fee.
2.5. Unless a different payment date has been expressly agreed in writing, invoices are due for payment immediately upon receipt.
2.6. Where a quotation, booking agreement or other written agreement specifies a different payment schedule, that agreed schedule will apply.
2.7. Payment may be made by bank transfer or another method agreed in advance.
3. Payment, Delivery & Suspension
3.1. Where any payment is due and remains unpaid, Shoots Photographs may withhold or suspend final image delivery, high-resolution downloads, gallery access, additional deliverables or further services until cleared payment is received.
3.2. An invoice may be issued when the agreed work or deliverables are ready for release. Issuing an invoice does not require Shoots Photographs to release unpaid deliverables before payment where payment is already due.
3.3. Where photographs have already been supplied at the same time as an invoice, any applicable licence to publish, reproduce or commercially use those photographs remains subject to the Copyright & Licensing provisions below and does not take effect until the relevant payment has been received.
3.4. Exercising a right to suspend delivery or access does not extend the payment due date or waive any right to recover sums properly due.
4. Professional & Creative Judgement
4.1. Photography is both a professional and creative service. I will use my professional skill, experience and judgement throughout every commission.
4.2. Unless specific requirements have been expressly agreed in writing beforehand, creative decisions including composition, framing, lighting, timing, image selection, cropping, posing, direction, colour treatment, editing, retouching and overall visual aesthetic remain matters of professional judgement.
4.3. I do not guarantee any particular photograph, expression, pose, moment or composition unless that requirement has been expressly agreed in writing in advance.
4.4. Clients are encouraged to review examples of my work before booking and to raise any particular style or creative requirements before confirming the commission.
5. Images — Editing, Selection & Delivery
5.1. Final photographs are selected and edited by Shoots Photographs.
5.2. Normal editing may include exposure adjustment, colour correction, contrast, cropping and appropriate light retouching.
5.3. Heavy retouching, extensive object removal, compositing, major manipulation, body alteration or specialist digital work is not included unless expressly agreed and may incur an additional fee.
5.4. The number of final edited photographs included, where applicable, will be stated in the package, quotation or booking agreement.
5.5. Unless expressly agreed otherwise, final photographs are supplied as finished JPEG files.
5.6. RAW files, working files, unedited JPEGs, outtakes and rejected frames are not supplied. They form part of my working archive and are not deliverables under the commission unless I expressly agree otherwise in writing.
5.7. Images are normally delivered through a private online gallery, secure download, Google Drive or another agreed method.
5.8. Turnaround varies depending upon the type and scale of commission. An estimated delivery period will normally be provided when booking.
5.9. Clients are responsible for downloading and securely backing up delivered photographs within any stated gallery-access period.
5.10. I may retain delivered photographs for backup purposes for a reasonable period but do not guarantee permanent archival storage unless specifically agreed.
6. Technical File Requirements
6.1. Where a client requires particular pixel dimensions, file sizes, colour spaces, compression settings, resolution, aspect ratios, print specifications, publication specifications or platform-specific exports, those requirements should be supplied before final export wherever reasonably possible.
6.2. Where no specialist technical specification has been provided, I will use professional judgement to supply finished files appropriate for the agreed purpose.
6.3. Online galleries, browsers, email clients, social-media platforms and cloud-storage services may display compressed, resized or altered previews. A platform or browser preview may therefore differ from the downloaded original file and should not automatically be relied upon when assessing final image quality or resolution.
7. Copyright & Licensing
7.1. Copyright in all photographs and other original creative work produced by Sharmaine Entwistle / Shoots Photographs remains with Shoots Photographs unless copyright is expressly assigned in writing.
7.2. Payment for photography does not transfer copyright.
7.3. Private Clients: Once all sums due have been paid, private clients receive a personal-use licence to print, share and display their delivered photographs for non-commercial purposes, including personal social media, gifts and home display.
7.4. Commercial Clients: Commercial clients receive the usage licence stated in their quotation, booking agreement or commission confirmation.
7.5. Unless expressly agreed otherwise in writing, any licence to use delivered photographs takes effect only once all sums due for the relevant commission have been received by Shoots Photographs in cleared funds.
7.6. Before the licence takes effect, delivered photographs may be reviewed internally for selection or approval but must not be published, reproduced, distributed, commercially exploited or supplied to unrelated third parties.
7.7. Images must not be sold, sublicensed, materially altered, misrepresented as another person’s work or used outside the agreed licence without permission.
7.8. Applying filters, edits or alterations that materially change the finished photographic work is not permitted without permission, except for reasonable cropping or resizing required by a website, publication or social-media platform.
7.9. Where personal images are shared publicly, a credit or tag to Shoots Photographs / @shootsphotographs is appreciated but is not mandatory unless otherwise agreed.
8. Use of Images by Shoots Photographs
8.1. Private-client photographs will not be used by Shoots Photographs for portfolio, website, marketing, social media, competitions, exhibitions or promotional purposes without appropriate permission.
8.2. Boudoir, intimate, erotic and fetish/kink photography is confidential by default and will not be publicly used without separate, specific permission.
8.3. Use of photographs from commercial commissions by Shoots Photographs for portfolio, website, social media, awards, exhibitions, teaching or self-promotion will be governed by the applicable commercial agreement or written permission and any confidentiality restrictions agreed with the client.
8.4. Further information about personal data, model releases and image privacy is contained in the Shoots Photographs Privacy Policy.
9. AI & Digital Manipulation
9.1. Client photographs will not knowingly be submitted by Shoots Photographs to third-party AI training datasets without appropriate permission.
9.2. Client photographs will not be used by Shoots Photographs to create AI-generated representations of a client without appropriate permission.
9.3. Images will not be materially digitally manipulated beyond the agreed editing process without appropriate agreement or consent.
9.4. Clients must not submit delivered photographs to AI training datasets or use them to create materially altered synthetic or AI-generated derivative works for commercial purposes without written permission from Shoots Photographs.
10. Cancellation by Shoots Photographs
10.1. Where Shoots Photographs is unable to carry out a booking because of illness, injury, emergency or another serious circumstance, I will notify the client as soon as reasonably possible.
10.2. Where appropriate and reasonably possible, I may offer an alternative date or, for a fixed-date event, seek to arrange a suitably experienced replacement photographer. Any replacement photographer will only be appointed with the client’s agreement.
10.3. If neither rescheduling nor a suitable replacement is reasonably available, sums paid for photography services that cannot be provided will be refunded.
10.4. Shoots Photographs is not responsible for remote or unforeseeable losses resulting from such cancellation. Nothing in this section excludes or restricts any liability or right that cannot lawfully be excluded or restricted.
Private & Consumer Clients
These sections contain additional terms relevant to private and consumer bookings.
11. Private & Consumer Client Rights
11.1. Nothing in these Terms & Conditions removes or restricts statutory rights available to a Consumer Client.
11.2. Services supplied to Consumer Clients will be carried out with reasonable care and skill.
11.3. Where applicable consumer law provides a cancellation or cooling-off right for a booking made online, by telephone or away from my business premises, that statutory right will apply.
11.4. Where a Consumer Client expressly requests that services begin during an applicable statutory cancellation period, the client may be required to pay for services already provided if they later cancel, where permitted by law.
12. Consumer Cancellation & Rescheduling
12.1. A booking fee or deposit may be required to reserve a date. The amount will be stated before booking.
12.2. If you need to cancel or reschedule, please give me as much notice as reasonably possible.
12.3. Where reasonably possible, I will try to transfer the booking to another available date.
12.4. Where a Consumer Client cancels, I may retain or charge an amount that reasonably reflects losses caused by the cancellation, including reasonable preparation already undertaken, costs already incurred and loss of the reserved booking opportunity, subject to applicable consumer law.
12.5. Repeated rescheduling, very late changes or non-attendance may be treated as cancellation and may result in reasonable charges reflecting the loss caused.
12.6. Weddings and other fixed-date events may have additional cancellation provisions because significant diary time is reserved exclusively for the client and the opportunity to replace the booking reduces as the event approaches. Those provisions will be stated in the applicable booking agreement.
13. Style, Expectations & Subjective Dissatisfaction
13.1. Photography is a creative professional service. Clients should review examples of my work before booking.
13.2. By booking Shoots Photographs, the client confirms that they have had the opportunity to familiarise themselves with my established photography and editing style.
13.3. My fees are charged for the professional service provided, including my time, skill, experience, preparation, equipment, photography, professional judgement, editing and agreed delivery. Payment is not conditional upon a client subjectively liking every photograph produced.
13.4. Where the agreed service has been carried out with reasonable care and skill, subjective dissatisfaction alone is not grounds for a refund, partial refund, reduction in price, complimentary reshoot, alternative editing or unlimited additional editing.
13.5. Subjective dissatisfaction may include:
- Preferring another photographer’s style;
- Disliking my established photographic or editing style;
- Preferring another composition, crop or colour treatment;
- Dissatisfaction with posing or facial expressions;
- Dissatisfaction with your own appearance or body image;
- Clothing chosen by you;
- Hairstyle, makeup or accessories;
- Behaviour during the session; or
- Deciding afterwards that you would have preferred a different creative approach.
13.6. Unless styling, hair or makeup has expressly been included in the booking, the client is responsible for their own clothing, hairstyle, makeup, accessories and personal presentation.
13.7. A client’s decision not to print, display, share, publish or otherwise use delivered photographs does not by itself mean that the photography service was defective.
13.8. Nothing in this section affects statutory rights where the service genuinely has not been carried out with reasonable care and skill or where an expressly agreed element of the service has not been provided.
Sessions & Specialist Services
These provisions apply where relevant to the particular service being booked.
14. The Session, Safety & Conduct
14.1. I will arrive prepared and use professional equipment appropriate to the agreed session or commission.
14.2. Where appropriate, I provide direction and guidance during the session.
14.3. Private clients are welcome to bring a companion for comfort unless the location or nature of the booking makes this impractical. Please tell me in advance who will be present at intimate sessions.
14.4. Clients should tell me in advance about accessibility needs, restrictions or circumstances that may materially affect the session so reasonable arrangements can be discussed.
14.5. I reserve the right to stop, suspend or refuse work where conditions are unsafe, abusive or threatening behaviour occurs, agreed boundaries are deliberately violated, unlawful activity is requested, or circumstances make it unreasonable or unsafe to continue.
14.6. Where a session is ended because of serious inappropriate conduct by the client or another person attending with the client, any refund or further obligation will depend upon the circumstances, work already carried out and applicable law.
15. Children & Young People
15.1. Children may be photographed as part of family, event or commissioned photography where appropriate arrangements have been made by a parent, guardian or commissioning organisation.
15.2. Booking and contractual arrangements for private photography involving children will normally be made with a parent or legal guardian.
15.3. Boudoir, intimate, erotic and fetish/kink photography is strictly for participants aged 18 or over.
16. Boudoir, Intimate, Erotic & Fetish/Kink Photography
16.1. All participants in adult-only sessions must be aged 18 or over.
16.2. Valid photographic identification may be checked visually. Identification will not normally be photographed, copied or stored.
16.3. A pre-shoot consultation will normally take place to discuss the concept, participants, boundaries, levels of dress, activities to be photographed, privacy, image usage and practical arrangements.
16.4. Each participant must consent independently. For couples or multi-person sessions, each participant must be involved in the relevant consent and boundary arrangements.
16.5. Consent may be changed or withdrawn at any point during the session and this will be respected immediately.
16.6. Any participant may pause or stop the session at any time. A safe word, signal or other agreed method of communicating boundaries may be used where appropriate.
16.7. Shoots Photographs provides professional photography services only. Requests for sexual services involving the photographer will be refused and may result in immediate termination of the session.
17. Weddings, Ceremonies & Events
17.1. Clients are responsible for ensuring that venues, officiants and organisers permit the agreed photography.
17.2. I am not responsible for photographs that cannot reasonably be captured because of venue restrictions, restrictions imposed by an officiant or organiser, schedule changes, delays, unavailable participants, lighting restrictions, restricted access, interference from guests or third parties, or photography being prohibited at a particular time.
17.3. Specific group photographs or particularly important requested photographs should be identified before the event wherever reasonably possible.
17.4. Live events are unpredictable and a particular expression, interaction or moment cannot be guaranteed.
17.5. Where weather or environmental conditions make outdoor photography unsafe or materially unsuitable, I may recommend an alternative location or rescheduling where reasonably possible.
18. Training & Mentoring
18.1. Unless otherwise agreed, photography training is bring-your-own equipment so tuition can be adapted to the camera, lighting or software actually used by the learner.
18.2. Training may be booked individually or in blocks. Applicable cancellation and rescheduling terms will be stated when booking.
18.3. Training materials, PDFs, downloads and other learning materials supplied by Shoots Photographs are for the learner’s own personal use and may not be redistributed, resold, copied for others or published without permission.
18.4. A responsible accompanying adult is required for one-to-one tuition involving a person under 18 unless another appropriate arrangement has expressly been agreed.
19. Gift Vouchers
19.1. Gift vouchers are valid for 12 months from the date of purchase unless otherwise stated when purchased.
19.2. Gift vouchers cannot be exchanged for cash.
19.3. Where the selected service costs more than the voucher value, the difference must be paid by the client.
19.4. Any statutory rights of the original purchaser are unaffected.
Commercial & Organisational Clients
The following sections contain additional terms specifically applying to commercial and organisational commissions. The Core Terms and other relevant provisions elsewhere on this page also apply unless expressly stated otherwise.
20. Commercial Quotations & Scope
20.1. Commercial quotations are based upon the information and requirements supplied by the Commercial Client at the time the quotation is prepared.
20.2. The Commercial Client is responsible for providing all material information necessary to price, prepare and undertake the commission.
20.3. Depending upon the commission, material information may include:
- The full brief and purpose of the commission;
- Required coverage;
- Locations and subjects;
- Shot lists;
- Timings and schedules;
- Required rooms, areas, facilities or activities;
- Key personnel;
- Required image quantities;
- Portrait and landscape requirements;
- Brand guidelines;
- Corporate house style;
- Example or benchmark imagery;
- Required compositions;
- Technical and file specifications;
- Intended usage and publication channels;
- Accessibility, safeguarding or site requirements;
- Confidentiality requirements; and
- Any specialist equipment or photographic technique expected.
20.4. A quotation does not automatically include significant requirements that were not disclosed when the quotation was prepared.
21. Late, Expanded or Changed Commercial Briefs
21.1. A material brief, requirement, shot list, brand guideline, example gallery, technical specification or creative direction supplied after quotation may constitute a change of scope.
21.2. Where the scope changes, Shoots Photographs may revise the quotation, charge an additional fee, require additional preparation or equipment, limit the commission to work that can reasonably be delivered, reschedule the work or decline the additional requirement.
21.3. A reasonable attempt by Shoots Photographs to accommodate a late or expanded brief does not automatically constitute agreement to provide materially additional services, attendance, equipment or further photography without charge.
21.4. Requirements, brand standards or visual references first supplied after photography has taken place cannot retrospectively become conditions of the original commission unless expressly agreed by both parties.
22. Commercial Style & Brand Requirements
22.1. Commercial Clients are expected to review examples of Shoots Photographs’ work before commissioning services.
22.2. Where a client has commissioned Shoots Photographs previously, that previous working relationship may form part of the parties’ understanding of the photographer’s established photographic approach.
22.3. Unless expressly agreed otherwise before the commission, Shoots Photographs retains professional and creative judgement over composition, framing, lighting, image selection, colour treatment, editing and final aesthetic.
22.4. Where photography must reproduce, closely emulate or comply with a particular corporate house style, existing photographic gallery, campaign aesthetic, brand standard or other visual benchmark, that requirement must be disclosed sufficiently early to allow the work, preparation, equipment and fee required to be properly assessed.
22.5. Relevant brand guidelines and visual reference material should be supplied before quotation wherever they materially affect the nature or cost of the commission.
22.6. A Commercial Client’s subsequent preference for a different style, look, aesthetic or creative direction does not by itself constitute defective performance.
22.7. Where the agreed professional service has been properly performed, dissatisfaction based solely upon style, composition, colour treatment, editing, poses, expressions, aesthetic preference or brand preference is not by itself grounds for refusing payment, reducing the agreed fee, obtaining a refund, requiring complimentary re-editing or requiring a complimentary reshoot.
23. Commercial Fees & Payment
23.1. Commercial fees are charged for the commissioned photography service, including agreed attendance, photography, professional judgement, editing and delivery. Fees are not charged per image unless expressly agreed otherwise.
23.2. The Client’s decision not to use, publish or approve some or all of the delivered photographs does not reduce the agreed fee.
23.3. A complaint, change of brief, change of brand direction, internal approval delay or subjective dissatisfaction does not by itself entitle the Client to withhold, reduce or delay payment.
23.4. Unless a different payment arrangement has been agreed in writing, invoices are due immediately upon receipt.
23.5. If payment is intended to depend on formal approval, acceptance criteria or another condition, that must be agreed in writing before the commission begins.
23.6. A Client’s internal purchase-order, approval or accounts process does not alter the agreed payment due date unless expressly agreed in writing.
23.7. Where a qualifying commercial invoice is overdue, Shoots Photographs reserves the right to exercise any rights available under applicable late-payment legislation.
24. Commercial Licence & Usage Rights
24.1. Unless expressly agreed otherwise, any commercial licence granted for use of delivered photographs takes effect only once all sums due for the commission have been paid to Shoots Photographs in cleared funds.
24.2. Prior to payment, delivered photographs may be circulated internally within the commissioning organisation where reasonably necessary for review, selection and approval but must not be published or otherwise commercially exploited.
24.3. Unless a different licence is stated in the quotation or agreement, once full payment has been received the Commercial Client receives a non-exclusive, non-transferable licence to use final delivered photographs for its own website, social media, publicity, marketing, reports, internal and external communications and printed promotional materials.
24.4. The client may provide photographs to printers, designers, publishers or other service providers where they are acting on the client’s behalf for a use permitted by the licence.
24.5. Unless expressly licensed, photographs may not be sold, supplied as stock photography, sublicensed for unrelated third-party commercial use, used on merchandise for resale or represented as having been created by another person.
25. Commercial Client & Event Organiser Responsibilities
25.1. The Commercial Client or event organiser is responsible for providing timely and accurate information necessary for the commission, including access arrangements, schedules, key contacts, relevant restrictions, brand requirements and other information material to the photography.
25.2. Where photography involves employees, residents, service users, students, patients, customers, guests, attendees or other third parties, responsibility for obtaining or establishing any necessary permissions, notices, lawful basis, safeguarding arrangements or internal authorisations rests with the Commercial Client or event organiser.
25.3. Shoots Photographs is entitled to proceed on the reasonable understanding that the Commercial Client or event organiser has made the necessary arrangements for photography to take place.
25.4. The Commercial Client or event organiser must inform Shoots Photographs of any individual who must not be photographed, any restriction upon photography or publication, and any safeguarding, privacy, access or organisational procedure that must be followed.
25.5. Where no such restriction is communicated, Shoots Photographs is entitled to proceed on the reasonable understanding that the necessary arrangements have been made.
25.6. Shoots Photographs is not responsible for a failure by the Commercial Client or event organiser to obtain required permissions, provide appropriate notices or comply with safeguarding or internal procedures that fall within their responsibility.
25.7. Shoots Photographs remains responsible for its own obligations under applicable data-protection law.
25.8. Shoots Photographs is not responsible for photographs that cannot reasonably be obtained because promised access, participants, activities, information, permissions or facilities are unavailable.
26. Additional Commercial Work, Re-editing & Reshoots
26.1. Services outside the agreed scope are additional work and may be quoted and charged separately.
26.2. Additional work may include further photography, further attendance, additional locations, additional rooms or areas, additional deliverables, extensive additional editing, re-editing to a newly requested style, specialist equipment, new creative requirements and reshoots.
26.3. A complimentary reshoot may be considered where an expressly agreed written requirement genuinely has not been delivered, the failure is attributable to an error by Shoots Photographs, and a reshoot is a reasonable and proportionate way of remedying that failure.
26.4. A reshoot will normally be treated as new chargeable work where it results from changed requirements, changed creative direction, new shot requests, new brand guidance, new visual references, requirements supplied after the original photography, subjective preference, a client’s decision not to use previously commissioned work, unavailable participants, inaccessible areas, site conditions, weather or other circumstances outside my reasonable control.
26.5. An offer to correct an omission, provide reasonable aftercare, supply additional photographs already captured or arrange a return visit does not automatically constitute agreement to provide unlimited or materially different additional photography without charge.
27. Commercial Review & Complaints Period
27.1. Commercial Clients should inspect delivered work promptly.
27.2. Any identifiable error, omission or alleged failure to meet an expressly agreed requirement should be notified to Shoots Photographs in writing within 14 calendar days of delivery.
27.3. The complaint should identify the specific requirement said to have been agreed, the alleged error or omission and the remedy requested.
27.4. If no identifiable issue is raised within that period, the delivered work will normally be treated as accepted for the purposes of the agreed commission. This does not prevent either party from raising a matter that could not reasonably have been identified during the review period or exercising a right that cannot lawfully be excluded.
27.5. The review period does not extend or suspend the payment due date unless Shoots Photographs expressly agrees otherwise in writing.
27.6. Making a complaint does not by itself establish an entitlement to withhold payment, reduce the agreed fee, receive a refund, obtain complimentary additional editing or require a complimentary reshoot.
28. Commercial Cancellation
28.1. Any cancellation terms expressly stated in the quotation or individual commission agreement will apply.
28.2. Where no separate commercial cancellation terms have been agreed, Shoots Photographs may charge a reasonable amount reflecting work already undertaken, costs already incurred, equipment or suppliers already committed, reserved diary time and losses caused by late cancellation.
28.3. For larger or fixed-date commissions, a separate cancellation schedule may be included in the quotation or agreement.
General Legal & Practical Terms
These provisions apply where relevant across Shoots Photographs services.
29. Privacy & Data Protection
29.1. Personal information and photographs are handled in accordance with the Shoots Photographs Privacy Policy and applicable data-protection law.
29.2. Private bookings are treated confidentially. I will not normally confirm to unrelated third parties whether an individual has booked or attended a private photography session.
29.3. Enhanced confidentiality applies to boudoir, intimate, erotic and fetish/kink photography.
29.4. Where a booking involves particular confidentiality, safeguarding, consent or data-handling requirements, these may also be recorded in the individual booking or commercial agreement.
30. Circumstances Beyond Either Party’s Control
30.1. Neither party will be treated as being in breach solely because performance is prevented or materially disrupted by circumstances outside their reasonable control.
30.2. Such circumstances may include serious illness or injury, accident, extreme weather, flooding, fire, public-health or government restrictions, venue closure, major transport disruption, failure of essential infrastructure or another comparable event outside the affected party’s reasonable control.
30.3. The affected party must notify the other as soon as reasonably possible and both parties should take reasonable steps to minimise disruption.
30.4. Where reasonably possible, the booking may be rescheduled or an alternative arrangement agreed.
30.5. If the affected service cannot reasonably be rearranged or provided, sums paid for services that have not been provided will be refunded, less any amount that may lawfully and fairly be retained for services already supplied or costs properly incurred where applicable.
30.6. To the extent permitted by law, neither party will be responsible to the other for indirect or unforeseeable losses or wasted expenditure arising solely from circumstances genuinely outside that party’s reasonable control.
30.7. Nothing in this section affects rights or liabilities that cannot lawfully be excluded or restricted.
31. Equipment Failure & Data Loss
31.1. I use professional equipment and reasonable working practices intended to protect client images.
31.2. Technology can nevertheless fail. If catastrophic equipment failure, corruption or data loss materially prevents delivery of the agreed service, an appropriate remedy will be considered according to the circumstances. This may include a reshoot, replacement service or refund where appropriate.
31.3. Nothing in these terms affects rights or liabilities that cannot lawfully be excluded or restricted.
32. Liability & Insurance
32.1. Shoots Photographs maintains public liability insurance for photography work.
32.2. I will exercise reasonable professional care when providing services.
32.3. I am not responsible for photographs that cannot reasonably be captured because of circumstances outside my control, including venue restrictions, instructions from officials or organisers, unavailable or uncooperative participants, unexpected schedule changes, restricted access, unsafe conditions or weather.
32.4. To the extent permitted by law, Shoots Photographs is not liable for indirect or consequential losses that were not reasonably foreseeable when the agreement was made.
32.5. Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded or restricted.
33. Changes to a Booking or Agreement
33.1. Material changes to a confirmed booking or commission should be recorded in writing.
33.2. For Commercial Clients in particular, changes to scope, deliverables, creative direction, usage, technical requirements or fees must be agreed before they alter the existing commission.
33.3. Neither party should rely upon material requirements or expectations that were never communicated to the other party.
34. Entire Agreement & Written Requirements
34.1. The applicable quotation, booking confirmation or booking agreement, these Terms & Conditions and any subsequent changes expressly agreed in writing together form the written record of the agreement between Shoots Photographs and the client.
34.2. Any material requirement, promise, specification, variation or additional service that either party wishes to rely upon should be confirmed in writing so there is a clear record of what has been agreed.
34.3. No material change to the agreed scope, deliverables, fees, usage rights or creative requirements will take effect unless agreed by both parties in writing.
34.4. Nothing in this section excludes liability for fraud or fraudulent misrepresentation or limits any consumer or other right that cannot lawfully be excluded.
35. Complaints
35.1. If you believe an agreed part of the service has not been provided correctly, please contact me in writing as soon as reasonably possible at Sharmaine@shootsphotographs.co.uk.
35.2. Please explain the specific issue and, where relevant, identify the agreed requirement you believe has not been met.
35.3. I will consider genuine concerns relating to errors, omissions, delivery or contractual requirements and will make reasonable efforts to resolve them fairly.
35.4. Making a complaint does not, by itself, establish an entitlement to a refund, reduction in fee, complimentary re-edit or complimentary reshoot.
35.5. For Commercial Clients, subjective dissatisfaction with photographic style, aesthetic preference or brand preference should be distinguished from an alleged failure to provide an expressly agreed requirement.
36. Website Information & FAQs
36.1. Information on the Shoots Photographs website and FAQ page is intended to explain services in plain language.
36.2. Where there is a conflict between general FAQ information and an expressly agreed quotation, booking agreement or these Terms & Conditions, the applicable contractual terms will take precedence.
37. Severability
37.1. If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be removed or modified only to the extent necessary. The remaining provisions will continue in force.
38. Third-Party Rights
38.1. Unless expressly stated otherwise, these Terms & Conditions regulate the agreement between Shoots Photographs and the client and do not create contractual rights for unrelated third parties.
39. Governing Law
39.1. These Terms & Conditions and agreements made under them are governed by the laws of England and Wales.
39.2. The courts of England and Wales will have jurisdiction over disputes, subject to any rights available to Consumer Clients under applicable law.
